This may be a question you’re asking yourself if you read this article from the New York Times
In which they quoted a person saying “Transgender people are frightened. At every step where the administration has had the choice, they’ve opted to turn their back on transgender people.”
or maybe you saw the article form the Guardian titled “Trump's laws cannot erase trans people, but it can allow others to hurt them”
In which they were slightly more conservative saying “(Trump’s policy) can allow others to hurt them with impunity.”
So what did trump do that has the NPCs so worried? Well,... nothing actually. What caused this outrage and this slew of articles predicting a transgender holocaust was the leaking of a internal memo from the Department of Health and Human Services that was released by the New York Times.
You’d think from the reaction form this memo that it was Trump Order 66 to eliminate the trannys, but you’re be wrong. The memo simply suggested that the department should define the term “sex” as meaning a person’s biological sex, not gender identity.
This upset gender identitarians because this policy would simply reverse the loosening of the definition of “sex” that happened during the Obama administration. As we all know, before Obama there were NO transgender people, right? Oh wait… they DID existed before Obama? and they weren't jailed or put into camps? Does that possibly mean that this suggested very minor change in policy might not actually be as bad as they are making it seem? Imagine my shock.
A series of decisions by the Obama administration loosened the legal concept of gender in federal programs, including in education and health care, recognizing gender largely as an individual’s choice and not determined by the sex assigned at birth. This resulted in the inability for schools, hospital, prisons and universities to limit access to bathrooms to a single sex. This is because with the new loose definition of sex, any person can change their sex at will. This created chaos for these institutions that now could be liable for violating a new civil right.
This chaos was not by mistake, The Guardian wrote “It’s a project that is part of a long history of queer and feminist efforts to expand the definitions of “man” and “woman” so that either category can encompass any kind of life, and so that those who choose to reject both labels altogether can do so in peace and dignity.” Their goal was to move society toward one where there is no difference between men and women.
Multiple articles made the claim that this memo would mean that “Trump’s” (new definition) would essentially eradicate federal recognition of the estimated 1.4 million Americans who have opted to recognize themselves — surgically or otherwise — as a gender other than the one they were born into. This Claim is completely, objectively and provably false.
The memo in question argued that key government agencies needed to adopt an explicit and uniform definition of gender as determined “on a biological basis that is clear, grounded in science, objective and administrable.” The agency’s proposed definition would define sex as either male or female, unchangeable, and determined by the genitals that a person is born with. Any dispute about one’s sex would have to be clarified using genetic testing.
It is important to note that the department’s memo was only a draft, though the meat of the memo is likely to become policy. Though the specific wording may change slightly. However we already know what the desired result and purpose of this memo is because it is not the first memo form the Trump administration on this topic. The purpose of the memo was to first, correct the chaos and liability in relation to bathrooms and locker rooms. Second, it was to create uniformity of the application of civil rights laws in four of the executive departments that deal with civil rights, The Departments of Education, Justice, Health and Human Services, and Labor. The purpose and the application of this definition is not and does not take away any rights or protection of transgender people.
Here's the facts:
Defining the protection of persons based on sex, as meaning biological men and women under article 9 or any other statute does not mean you can discriminate against transgender people. This is because they are multiple other laws that guarantee protections for transgenders:
These laws prohibit discrimination based on, sex, and genetic information. The US equal opportunity Commission has also held that discrimination against an individual because of that person's sexual orientation is discrimination because of sex and therefore prohibited
There is existing president from our courts that have determined that transgenders are protected under the protections for sex.
The only difference is federal and civil entities will not be required to make separate considerations for every sexual identity. Now the government will not force their to be co-ed or bathrooms, and government forms can simply identify male or female.
Lastly and most importantly, you remember that earlier Trump memo that I mentioned? Well that memo form the attorney general published on 4 October 2017 was a guide for these other departments to follow and clearly states the Trump administration's views of the rights of transgenders. It reads “Although federal law, including Title VII, provides various protections to transgender individuals, Title VII does not prohibit discrimination based on gender identity p er se. This is a conclusion of law, not policy”
The purpose of this memo was to clarify that Transgender people DO have protections form discriminations by law and specifically for employment. The memo also clarifies that Gender Identity is different and apart from being transgender and sex.
So, to summarize, The memo that feminists are upset about does not remove rights from transgender people. In fact the trump administration has unequivocally maintained that transgender status is just as protected as being male or female. All of the news agencies and commentators that are claiming that trump had created an anti-trans policy are not simply wrong, but based on the laws and the memos, they are simply lying to us.
